- Basic steps in the criminal justice system:
- Investigation: Police seize evidence and talk to witnesses. Police present evidence of probable cause to a judge. Police conduct research. Police present evidence to a prosecutor. Judge issues a search warrant.
- Need a search warrant b/c of 4th Amendment
- Direct Evidence--information provided either by a witness who saw the crime, or by a video or audio of the crime
- Circumstantial Evidence--information that can be inferred from other facts
- Arrest: judge issues an arrest warrant. The suspect is read the Miranda Rights. Police present evidence of probable cause to a judge. Suspect is booked. Suspect is arrested.
- Arrest warrant--issued by the judge and is based on probable clause
- Warrant-less Arrest--when officers find likely suspect(s) at the scene of the crime
- Pretrial: Suspect is released on bail. Suspects makes an initial appearance in court. Suspect accepts a plea bargain. Suspects is arraigned. Grand jury hears the case.
- Trial: Jurors are selected randomly and are sent to a jury summons. Prosecution and defense present evidence and call witnesses. Lawyers issue peremptory challenges. Jurors deliberate. Jurors are challenged "for cause". Jury foreman announces the verdict.
- Sentencing and Appeals: Judge chooses to apply an indeterminate sentence. Judge requests a pre-sentence report. Appeals court denies appeal. Defendant requests an appeal.
- Corrections System: Parole board hears testimony and examines evidence. Prisoner is sent to a minimum-security prison. Prisoner is released. Prisoner applies for parole.
